Am I Eligibility to Apply?

  • You should be a Filipino citizen, at least 23 years old but not older than 65 years old when your loan matures.
  • Your home and business address should be within any of the bank’s service regions.
  • You should have the following active contact numbers: home landline, office or business landline, and mobile number.
  • If you are locally employed, you should be with your current employer for 2 years work tenure and earning a minimum salary of Php 25,000. Your employer should be one of the Top 7,000 companies in the Philippines.
  • If you are a Professional or Self-employed, you should have been in the same profession or the same business for at least 3 years. As a business owner, your business should have been operational for the past 3 years with at least 2 continuous years of profitability; an average monthly income of Php 200,000 and business should be duly registered with DTI or SEC.

Terms and Conditions

MAYBANK PERSONAL LOAN TERMS AND CONDITIONS

1. OBLIGATIONS OF THE BORROWER. For every failure to fully pay each monthly installment on or before due date, a penalty per annum counted from the day immediately after each installment due date until fully paid, shall be charged for every month or fraction thereof that a monthly installment remains overdue.

It is agreed that the interest on the loan and/or the principal amount of the obligation shall be subject to proportionate upward or downward adjustment if, during the term of this loan, an extraordinary inflation or deflation, official or unofficial appreciation or depreciation, of the Philippine Currency occurs, or in case of any increase or decrease in the prevailing market interest rate for the same or similar type of loan, or if government laws or regulations which have the effect of increasing or decreasing the lender's cost of fund are enacted, or in case of extraordinary increase or decrease of the effective value or the purchasing power of the Philippine Currency or similar events. An increase at any one time of twenty five percent (25%) in the Consumer Price Index for Manila as set forth in figures officially released by the Bangko Sentral ng Pilipinas (BSP) or by other agencies of the Philippine Government (should the figures of the BSP not be available) shall be considered as an extraordinary decrease in the effective value of the purchasing power of the Philippine Currency. I/We agree that if any of the conditions mentioned above should supervene, the Bank shall make the necessary adjustment in the sum outstanding and payable under this Note, and except for manifest error in the computation thereof, the same shall be binding and effective upon me/us. Should I/we disagree, with the adjustment, I/we shall have the right to prepay in full the obligation under this Note. In the event that I/we do not prepay the obligation under this Note within a period of thirty (30) days from receipt on the notice of the adjustment from the Bank, I/we shall be deemed to have agreed to the adjustment.

In case of my/our failure to pay when due and payable, any sum which I/we are obliged to pay under this Note and/or any other obligation which I/we or any of us may now or in the future owe to the Bank or to any other party, whether as principal or guarantor, or in the event of bankruptcy, insolvency, receivership, levy or execution, garnishment or attachment, or in the case of conviction for a criminal offense by final judgment carrying with it the penalty of civil interdiction, affecting all or any one of us, death or dissolution (in case of corporation), or in any of cases covered by Article 1198 of the Civil code of the Philippines, then the entire sum outstanding under this Note shall immediately become due and payable.

2. COLLECTION FEES, ATTORNEY’S FEES AND LEGAL EXPENSES. If suit is commenced on this contract, or the same is referred to an Attorney-at-law. I/We jointly and severally agree to pay the Bank an Endorsement Fee of 1% of the sum due but which shall not be less than Php2,000 nor more than Php10,000 and an additional sum equal to twenty-five percent (25%) of the total sum due as attorney's fee plus an additional sum equivalent to twenty five percent (25%) of the total sum due as liquidated damages, or aside from expenses of collection and costs of suit.

3. VENUE OF LEGAL ACTION. Any legal action to enforce payment on this contract shall be brought in or submitted to the jurisdiction of any court in Metropolitan Manila or in any province or in any municipality or city where the Bank has an office.

4. RIGHT OF LIEN AND SET OFF. As applicable, I/we hereby authorize the Bank to debit from my/our Savings/Checking Account maintained at Maybank Philippines, Inc. for the payment of my/our loan amortization or all such other amounts that may be due to the Bank under the provisions of this Note and such other documents executed in connection therewith as amortization and/or amounts may respectively fall due by acceleration or otherwise. The Bank will not debit my/our Savings/Checking account if the outstanding balance thereon is not sufficient, cleared and available for debit to cover the payment in full of the loan amortization or all such other amounts at the same time that the same is due in which case, I/we shall be liable to the payment of such penalty charges on all such overdue, amortization and/or amounts as provided for in this Note.

5. NOTICES AND CORRESPONDENCES. All correspondences, notices, requests, demand letters, court documents such as summons, subpoena, pleadings, or orders shall be given or sent to me in writing and sent to my given or declared address, and/or electronic means such as electronic mail (E-MAIL), or other messaging platforms such as (but not limited to) SMS or Viber at the numbers and/or e-mail addresses provided by me/us during the loan application and/or submitted or provided to the Bank prior to or subsequent to the execution of this agreement. The mere act of sending any correspondence by mail, personal delivery courier, or electronic mail (e-mail), or thru other various platforms to the said address / number / e-mail address shall be valid and effective notice to me/us for all legal intents and purposes. The failure to receive such correspondence or if the address given is fictitious or cannot be located or is not actually received by me/us or has been returned UNCLAIMED to the creditor or the Bank or the creditor’s e-mail notice returned because the e-mail address is no longer active, and/or the declared contact number are no longer in use, shall not excuse or relieve me/us from the effects of such correspondence or notice as if it was actually received. I/We undertake to immediately notify the Bank in writing or through a notice duly given to Maybank Customer Care and branches of any change in Personal or Business Data specifically, residence address, office/business address, contact number (landline or mobile phone) e-mail address, and all related information. No change of residence/ mailing address, e-mail address, or contact number shall be valid and binding upon the Bank for legal purposes, unless a Notice is duly given to Maybank Customer Care and branches on change of residence/ mailing address, e-mail address, or contact number is served to the Bank/ creditor.

6. SECURED OBLIGATIONS. As applicable, this Note will remain secured by any mortgage I/we have given or will give to the creditor (or its assignee), unless the creditor (or its assignee) has officially released that mortgage in writing.

7. COMMON PROVISIONS. Acceptance by the Bank hereof of payment or any installment or any part thereof after due shall not be considered as extending the time for the payment of any of the installments aforesaid or as a modification of any of the conditions hereof.

I/ We hereby authorize the Bank to designate the application of my/our payment to either the principal under this Note, due interest, charges and expenses or to any of my/our existing obligations with the Bank, at the latter's discretion, any right under Article 1252 of the Civil Code to the contrary notwithstanding. The Bank holds no responsibility in presenting the original promissory note or notice of dishonor to the borrower before it can demand payment or declare the obligation due and demandable.

8. COOLING OFF PERIOD. I/We hereby acknowledge that I/we am/are entitled to a Cooling-Off Period (COP) of two (2) banking days from the signing of this Note under which, I/we may request for the cancellation of the loan within the COP without paying pre-payment charges, and provided further that, cancellation fee, service fees, processing fees, and accrued interests, if applicable, shall be paid by me/us. If I/we submitted the loan cancellation request after the COP, I/we shall no longer be eligible to avail of the COP rights, thus, cancellation and pre-payment charges shall apply. I/We must notify the Bank within the COP and express in writing the loan cancellation request. In the event the loan has been booked or disbursed after receiving the loan cancellation request within the COP, the following conditions shall apply:

a) I/We must FULLY PAY the amount stated on the SOA (including disbursed loan, accrued interest, cancellation fees, service fee, documentary stamp tax, notarial fees, other taxes and processing fees, where applicable) within three (3) banking days after submitting the loan cancellation request;

b) If I/We fail to FULLY PAY within the prescribed period, standard loan cancellation and pre-payment charges shall apply.

Should I/we avail of the COP, I/we hereby agree to send my/our loan cancellation request to the Bank via e-mail to a designated e-mail address specified in this Note. When applicable, the date of signing of this Note, instead of the notarization date shall be the reckoning date of the availment of COP.
