Maybank Personal Loans Terms and Conditions
1) I/We hereby affirm that all information provided in this application and in all supporting documents are accurate, correct and true, and made for the purpose of obtaining credit. I/We further authorize Maybank Philippines, Inc. (MPI) to obtain and verify any and all information as may be required from whatever source/s that MPI may consider appropriate and necessary in the evaluation of my/our loan application. In this connection, I/we hereby expressly give my/our consent to the disclosure or sharing of such information, if applicable, that may be protected under any and all statutory and regulatory provisions governing confidentiality or secrecy of any bank account. I/We fully understand that any misrepresentation, falsity or failure to disclose on my/our part as required herein, may cause the disapproval of my/our application and can be construed as an act to defraud MPI for which civil and/or criminal liability can be pursued against me/us. I/We agree to promptly notify MPI of any material change affecting information mentioned herein.
2) I/We understand that MPI may at its sole and absolute discretion, deny my/our loan application with no obligation on its part to furnish the reason thereof. I/We agree that all information obtained by MPI shall remain MPI's property whether or not the loan was granted.
3) I/We understand that MPI may provide notices to me/us in regard to my/our loan account/s with MPI, in written or electronic form i.e., MPI’s website, electronic mail (e-mail), and other messaging platforms (such as but not limited to Short Messaging Service (SMS), Viber, etc.) and accordingly, I/we agree to receive such notices, including SMS broadcast from MPI.
4) I/We agree and understand that all notices, requests, demand letters, court documents such as summons, subpoena, pleadings, or orders shall be given or sent in writing and sent to the address indicated in my/our application including and/or electronic means such as e-mail, or other messaging platforms (such as but not limited to Viber, SMS, etc.) provided by me/us during the loan application and/or submitted or provided to MPI prior to or subsequent to the execution of my/our loan. The mere act of sending any correspondence by mail, personal delivery courier, e-mail, or other messaging platforms (such as but not limited to Viber, SMS, etc.) to me/us as may be elected by MPI to the said address / number / e-mail address/ or any contact detail shall be valid and effective notice to me/us for all legal intents and purposes. The fact that such correspondence is not actually received by me/us, or has been returned UNCLAIMED to MPI, or that no person is found in the said address or that the address is fictitious or cannot be located, or that my/our e-mail notice returned because the e-mail address is no longer active, and/or the declared contact number/details are no longer in use, shall not excuse me/us from the effects of such correspondence or notice as if it was actually received. In addition, I/we hereby authorize MPI and its representatives to proceed to my/our office or business address for the purpose of serving of notices, requests, demand letters, and court documents such as summons, subpoena, pleadings, or orders. I/we undertake to immediately notify MPI in writing of any change in Personal or Business Data specifically, residence address, office/ business address, contact number (landline or mobile phone) e-mail address, and all related information. No change of residence/ mailing address, e-mail address, or contact number shall be valid and binding upon me/us for legal purposes, unless a notice is duly given to Maybank Customer Care on change of residence/ mailing address, e-mail address, or contact number.
5) I/We understand that MPI may send notices to/me us in regard to the updated fees and charges of my/our loan in written or electronic form, i.e., Bank’s website, e-mail and/or other messaging platforms that may be used by the Bank, and accordingly, I/we agree to receive such notices from MPI.
6) In the event of future delinquency, I/we hereby authorize MPI to report and/or include my/our name in the negative listings of any credit bureau or institution. Furthermore, I/we hereby authorize and commit to assist MPI and/or the latter’s authorized agents or representatives or affiliates in obtaining information or documents regarding my/our assets or properties of whatever kind and nature from third parties, including without limitation, any and all government agencies or instrumentalities, local or national, or any private institution and all other businesses that provide said information for purposes of the Bank’s collection initiatives against me/us. I/We hereby expressly agreed and confirmed that herein authorization shall be sufficient for MPI to conduct, inquire or obtain information and/or documents on my/our assets and properties for MPI’s mentioned purposes without the need for me/us to execute a separate authorization document in favor of MPI.
7) Should it become necessary for MPI to refer my/our loan to an external collection agency or a lawyer, I/we agree to pay, on top of the outstanding obligation under this loan, any or all of the following fees and expenses, whichever is applicable but not limited to: (a) Collection fees (b) Attorney’s fees (c) Liquidated damages (d) Legal costs provided for in the Rules of Court; and (e) Litigation expenses including but not limited to filing fees, premium for the replevin bond; as indicated in the fees and charges.
8) I/We agree to waive confidentiality of client information as provided under the relevant laws, including the Data Privacy Act of 2012, and for this purpose, hereby appoint MPI as my/our Attorney-in-fact to obtain and receive personal information from any government agency including but not limited to the Bureau of Internal Revenue and other Local government Offices for the purpose of establishing my/our payment capacity, and validation of documents submitted by me/us. I/we authorize MPI to disclose my/our information, the obligation, and the performance of the obligation under this loan to MPI’s subsidiaries, affiliates, agents including accredited external collection agencies and legal counsels, and other third parties that are authorized by MPI to receive such information in relation to the latter’s exercise of its right to enforce this terms and conditions of this loan, and/or for the protection of its right and interest. Unless there is proven negligence of the Bank and/or its directors, officers, employees, and authorized representatives and third parties, I/we shall indemnify and hold the Bank and/or its directors, officers, employees, and authorized representatives free and harmless from any and all liability arising out of any violation by the third parties authorized to receive information in accordance to the law on Secrecy of Bank Deposit, Data Privacy Act, General Banking law, and other relevant and applicable laws.
I/We understand and agree that the MPI may utilize available and appropriate methods to document and record any and all verbal communications relevant to the enforcement of this terms and conditions. As such, MPI and/or its accredited and authorized agents may, with prior notice to me/us, may use call recording and body cameras during their official interaction including the telephone call reminder for the payments or field visit to my/ our address.
9) I/We allow MPI to provide to the appropriate regulatory agencies and/or authorities and/or to Malayan Banking Berhad, its affiliates or branches, any information pertinent to my account(s) and/or as may be stipulated under the applicable laws, regulations, guidelines, directives or agreement.
10) By acceding to the Bank's Terms and Conditions for account opening and accommodation for the loan subject of this application and other financial products, I/we agree that MPI may collect, hold, use, and share my/our Personal Information pursuant to the Data Privacy Act of 2012 (Republic Act No. 10173) for so long as I/we remain to be a client and for as long as my/our records and Personal Information are required and/or allowed by law to be retained and processed, whether for my/our protection and pursuit of the legitimate interests and/or business purposes of MPI, such as (but not limited ) to provision of any service or product to me/us , or relating to my/our deposit account, outsourcing purposes and for data processing or storage, statistical and risk analysis and risk management purposes.
